EU Data Act and Portability
This page provides general information about switching and data portability under the EU Data Act in relation to Aam Digital’s hosted services, irrespective of the contractual form through which the relevant hosted service was agreed, where and to the extent the applicable EU Data Act switching provisions apply.
For Customers using our hosted Service under our current standard Terms of Service, the legally binding switching terms are set out in Sections 20.4 to 20.8 of those Terms. Where a Customer uses the hosted Service under another agreement, the applicable agreement and mandatory law govern the Customer’s contractual rights and obligations. This page does not amend or override customer-specific contractual arrangements.
Requesting a switch
Customers may request to switch an affected Aam Digital Customer Instance to another provider, transfer the relevant data to their own infrastructure, or terminate the affected Customer Instance and have the relevant exportable data erased.
Switching requests can be submitted in text form to info@aam-digital.com. Please identify the affected Customer Instance(s) and the requested switching option.
The maximum standard notice period for initiating the switching process is 30 calendar days.
Data available for portability
The portability package includes the data stored in the Customer-specific application database, including Customer Content, Customer-specific configuration and settings, data-model or schema definitions, records, relationships and associated metadata. Where used, Customer-uploaded files and attachments are also included.
Aam Digital does not use a fixed or standardized customer data schema. Customers configure their own data types, fields, relationships and other data-model elements. The structure of the portability package therefore depends on the configuration of the relevant Customer Instance.
Under Aam Digital’s current standard portability method, the main application database is provided as a JSON file. Aam Digital may use another structured, commonly used and machine-readable format where appropriate and in accordance with applicable law. Customer-uploaded files and attachments are included where applicable. The technical delivery method or packaging for files and attachments may depend on the technical implementation available at the time of switching.
Technical access and limitations
Aam Digital makes the switching access required by applicable law available without a separate switching charge and subject to appropriate authentication and security controls.
Because Aam Digital uses an offline-first architecture, Customer Content may also exist locally on devices controlled by Customers or Authorized Users. Aam Digital cannot independently retrieve data that exists only on such a device and has not synchronized with the hosted Service. Customers should therefore ensure that relevant devices have synchronized before switching.
Timing, retrieval and deletion
The standard transitional period is up to 30 calendar days, subject to the extensions and exceptions described in the applicable Terms of Service, other applicable agreement, and mandatory law.
After successful switching, the portability package remains retrievable for 30 calendar days unless a later date is expressly agreed. Normal application access does not need to remain available during this period. After the applicable retrieval period, Aam Digital erases the data subject to the applicable EU Data Act erasure obligation from Provider-controlled systems, subject to legal retention requirements.
Charges
Aam Digital does not impose switching charges for actions it is required to perform under the EU Data Act switching process. Normal service fees remain payable until termination of the affected Customer Instance. Customers may separately purchase additional services that go beyond Aam Digital’s mandatory switching obligations.
For fixed-term Paid Plans, proportionate early termination compensation may apply where permitted by applicable law and as provided in the applicable agreement. Such compensation is not a switching charge.
Infrastructure and protection against unlawful governmental access
Aam Digital’s standard hosted service uses core production infrastructure located in Germany. Additional infrastructure used in connection with the hosted Service, including backup infrastructure, may be located elsewhere within the EU/EEA. Customer-specific hosting or processing arrangements may use infrastructure in other jurisdictions where expressly agreed with the Customer.
Further information on our standard infrastructure and subprocessors is available in our List of Standard Subprocessors. Where a Customer-specific arrangement applies, the relevant contractual or customer-specific documentation identifies the applicable arrangement.
For data held in the European Union, Aam Digital uses technical, organizational and contractual safeguards designed to protect against unlawful access or transfer requested by authorities of third countries. In our standard hosted setup, these measures include EU-based core infrastructure, encryption in transit and at rest, encrypted backups, restricted administrative access, security and confidentiality requirements, and appropriate contractual protections.
Aam Digital assesses governmental requests for Customer data for their legal validity and scope. We do not voluntarily provide Customer data in response to requests that are not legally binding. Where legally permissible and appropriate, we reject or challenge unlawful or disproportionate requests, limit any disclosure to the information legally required, and inform the affected Customer where permitted by law.
Where this page describes Aam Digital’s standard service model, a different customer-specific arrangement expressly agreed in the applicable contract or other binding customer-specific documentation prevails for that Customer.
